Seventh Circuit Decision Regarding Rubber Bullets and Excessive Force
In Waukesha, Wisconsin a woman was apprehended by police after reportedly driving a stolen vehicle while intoxicated. Police deemed her a threat based on the residential location and position of her car and utilized four SL6 shots to get the suspect to leave the vehicle. One of these shots tore flesh from the woman’s ankle. The woman sued the police department for the injuries she sustained. Two trials were held, the first ending in a hung jury and the second ending in favor of the police. The defendant appealed and the Seventh Circuit Court of Appeals ruled in her favor deeming the rubber bullets were used with excessive force in her case. The court explains the use of the bullets was not an illegal use by the officers, but rather was overused in this case, thus deeming it excessive.
