Bar Not Liable For Injury Caused By Underage Drinker

Back in 2010, Jennifer Serkowski was injured by a friend after they had both been drinking at Bonnie and Clyde’s Hideaway, a bar in Watertown, Wisconsin. Ms. Serkowski sued the bar, claiming that the bar was negligent in serving her friend because she was underage. A trial court determined that the bar was not liable for Ms. Serkowski’s injury, because her friend provided false identification and appeared to be of legal drinking age. The Court of Appeals of Wisconsin affirmed the trial court decision, holding that Ms. Serkowski failed to prove that the bar acted in bad faith.
