Cities Only Liable when Potholes Cause Injury

This winter has been brutal in many ways, including in its effect on Wisconsin’s roads. Potholes are wreaking havoc on vehicles, causing damage to tires, rims and other vehicle parts. In Milwaukee, many people have filed claims with the city to recover for the damage caused to their vehicles by potholes. Under Wisconsin law, however, a city such as Milwaukee is only liable when a pothole causes personal injuries. As a result, most pothole claims are denied. For example, from September 2013 to February 2014, 31 people filed claims with Milwaukee for damages less than $20,000. The city has denied all of the claims. In fact, since 2008, Milwaukee has paid only seven pothole claims.
