Out-of State Collision and Uninsured Motorist Coverage Settlements for Wisconsin Resident

Our client, who was a Wisconsin resident and a passenger in a friend’s vehicle, was visiting in another state when the friend’s vehicle was struck by an uninsured motorist. The other vehicle, which was proceeding out of a parking lot, failed to stop for a red traffic light, striking our client’s friend’s vehicle which had been traveling on a city street. Our client’s friend had vehicle liability insurance on the vehicle; however, the other driver did not have any vehicle liability insurance in effect at the time of the collision. Due to our client’s injuries, resulting in a surgery and a permanent injury; our client’s extensive medical expenses; our client’s lost wages; and our client’s pain, suffering and disability; the lawyers of Samster, Konkel & Safran, S.C. were able to accomplish two different settlements for our client. The first settlement involved demanding and obtaining the limit of medical expense coverage available under the friend’s auto insurance policy, in addition to demanding and obtaining the limit of uninsured motorist coverage available under the friend’s automobile insurance policy, due to the lack of insurance for the other at-fault driver. We were then able to negotiate a reduction in reimbursement to our client’s health insurance company which had previously paid a significant amount of our client’s medical expenses. The second settlement involved pursuing additional claims, pursuant to both the medical expense coverage and the uninsured motorist coverage available from our client’s personal vehicle liability insurance policy, even though our client’s vehicle was not involved in the vehicle collision. In the second settlement, the lawyers of Samster, Konkel & Safran, S.C. demanded and were able to obtain the limit of medical expense coverage available under the policy, in addition to obtaining a significant amount of the uninsured motorist coverage available under the policy. We were then able to negotiate an additional reduction in reimbursement to our client’s original health insurance company, and also work to get medical bills paid by our client’s new health insurance company. Although this vehicle collision occurred out-of-state, the lawyers of Samster, Konkel & Safran, S.C. were able to accomplish these settlements and health insurance reimbursement reductions without the need to file a lawsuit or utilize attorneys in the state where the vehicle collision occurred.
