On June 24, 2010, a 13-ton concrete panel fell from the O'Donnell Parking Garage near Summerfest, killing a 15-year-old boy and injuring two others. This tragic event has led to a large number of lawsuits, which have been consolidated into one case. As that case has proceeded, the parties involved continue to place blame on each other. Milwaukee County, which operated the garage, blames Random Lake firm Advance Cast Stone for faulty installation of the concrete panel, and Fond du Lac firm C.D. Smith Construction Company for improper construction of the underlying concrete walls. The construction manager, J.D. Findorff & Son, Inc. of Madison, is also a Defendant in the case. All three companies deny wrongdoing. Milwaukee County is blamed for failing to detect the defective condition of the concrete panel. The City of Milwaukee faces liability in the case because it was responsible to inspect local building projects. Both the County and the City deny any responsibility for the accident.
It is certainly not unusual for Defendants in a lawsuit to deny responsibility and to blame each other. Samster, Konkel & Safran, S.C. Milwaukee personal injury lawyers will continue to monitor this case.
