Elmbrook School District Will Appeal Graduation Lawsuit

Between 2000 and 2009, the Elmbrook School District held its high school graduation ceremonies at Elmbrook Church. Students requested the ceremonies be held at the church due to its ample seating, air conditioning and handicapped access. Americans United for Separation of Church and State sued the school district, claiming that holding public school ceremonies at a church violated the United States Constitution.

After a trial court dismissed the lawsuit, the United States Court of Appeals for the Seventh Circuit ruled against the school district.

On Tuesday, August 21, 2012, the Elmbrook School Board voted to appeal the Seventh Circuit decision to the United States Supreme Court. Samster, Konkel & Safran will continue to monitor this case
