While responding to a report of a gas leak emergency with his siren and emergency lights operating, a taxicab driver failed to yield the right of way to the emergency vehicle. The taxicab driver was ticketed by the City of Milwaukee Police Department for violation of Wisconsin Statute Section 346.19, requiring an operator of a vehicle to yield the right of way upon "the approach of any authorized emergency vehicle giving audible signal by siren."

As a result of the vehicle collision, our client suffered injuries and was transported by ambulance to Froedtert Hospital in Wauwatosa. Because the officer was on duty, City of Milwaukee paid Workers compensation benefits, including the medical expenses and lost wages.
